SCOTS can vote to ensure our politicians and judges have the final say over our own laws the leave campaign have said.

Using the argument that has raged over minimum pricing, Tom Harris, Director of Scottish vote leave said the EU court has blocked the will of the Scottish Parliament.

The policy has been challenged in the European Court by the Scotch Whisky Association, which Mr Harris said makes sovereignty meaningless.

He said: “This policy, supported by a wide range of health experts in Scotland, was seen as a vital weapon in the fight against Scotland’s chronic and damaging drinking culture. It was a policy that had the support of the Scottish people and of the vast majority of our democratically-elected MSPs.

“But it didn’t have the support of the European Court of Justice which decided, from its location in Luxembourg, that saving lives and improving the health of our citizens was not justification enough for falling foul of single market rules.

“We cannot effectively govern or implement democratically-approved policies while we are in the EU.”

Politicians campaigning to leave the EU predicted a historic result as polls put the outcome too close to call.

Boris Johnson said if all those who back getting out of the EU turnout it will tip the balance

The Former Tory London Mayor said: "I do think that we are on the verge, possibly, of an extraordinary event in the history of our country and indeed in the whole of Europe.

"It's all going to be about getting our supporters out to vote and if we do it I really think tomorrow can be ‘independence day’."

Ukip leader, David Coburn, predicted that Scots would vote to leave the EU despite opinion polls suggesting a majority in favour of remain.

He said: "I think there is a majority for Leave in Scotland or it is very close.

"People are not happy with what the SNP have been saying and a good deal of the SNP members themselves do not agree with their leadership and are going to vote Leave."

Even if he is wrong and the vote is in favour of the EU Mr Coburn said the campaign would go on.

He added: “We will continue to fight because I believe very much that all the things the European Union has been hiding will suddenly come out of the attic.

"They will release all these mad grannies from the attic to do whatever they want - unacceptable decisions will suddenly be foisted on the British people and they will find Cameron has lied to them, and I would very much think you will see at the next general election a revulsion of that, and you will see that Mr Farage might be leading a coalition government."
