A MAN was fined and disqualified from driving after he refused to take a breathalyser test.

Christopher Carlin was sentenced at Glasgow Sheriff Court after police suspected the 28-year-old was driving his mum’s car while under the influence of drink.

The court heard that the officers observed the accused travelling in a car at speed towards them.

They ordered him to stop and then immediately smelled alcohol coming from the accused.

Carlin, of Keystone Road, Milngavie, was then taken to Clydebank Police Office where he refused to give samples of breath. He then started to struggle with officers and screamed that he was going to “kill them”. He was then restrained and then spent four nights in custody - causing him to miss his son’s third birthday.

Carlin admitted that on May 28 this year at Clydebank Police Office he failed to provide two specimens of breath to ascertain his ability to drive. He also admitted that on the same day at the same place he struggled with two police officers, threatened them with violence and spat on the floor.

Carlin’s defending solicitor said his client’s reaction towards police was that of a young man in panic who had never been in that situation before. He was fined £1,300 and disqualified from driving for 16 months.
