A LAD who antagonised another man by pulling a comical face failed to see the funny side when his two front teeth were chipped in the altercation.

Glasgow Sheriff Court was told that the victim and his friends were eating in McDonald's in Kirkintilloch's Milton Road on February 8 last year when Gary Bell entered the fast-food restaurant at around 12.30am.

The 26-year-old accused ordered and then returned to the front entrance area.

While separated by a glass panel, there was an exchange of words between Bell and his victim – who was sitting nearby. During the spat, the complainer put his face to the glass and made a "funny face" at the accused.

In response, Bell booted the bottom of the glass. However, the panel flexed with the vibration and smacked the victim on the face – chipping his two front teeth.

The police were called and Bell was arrested. The victim later had to pay £130 to get his teeth fixed.

Although pleading guilty to culpably and recklessly kicking the window, whereby it struck his victim on the head to his injury, Bell's defence agent claimed that the offence was more accidental than malicious.

The accused, who had initially walked away to avoid a confrontation, retaliated after the provocation continued. Nobody expected the glass to flex as it did and hit the complainer.

Accepting there was a degree of provocation, the sheriff fined Bell, of Hurrier Drive, Twechar, £350.
