A DRUNKARD caught whizzing in the street lashed out with a glass bottle when he was told to zip up and move on.

At Glasgow Sheriff Court, Joseph Maguire pleaded guilty to relieving himself outside The Granary in Shawlands on July 20 this year.

The 49-year-old also admitted repeatedly shouting and swearing, uttering threats of violence, brandishing a glass bottle at a man and refusing to desist.

The fiscal depute told the court that it was around 10.15pm when the accused was spotted near the locus urinating in a bin. A member of the public told him to stop and go somewhere else.

Maguire asked the witness if he was a member of the security staff. When told no, the accused started acting in a threatening manner by shouting and swearing.

Another member of the public intervened and asked Maguire to calm down. At this, the accused took a Budweiser bottle and brandished it at the man.

He walked towards the complainer while shouting and swearing. During his tirade, Maguire threatened to find out where the man lived and would murder him.

The police were called and the accused was cautioned and charged.

Maguire, who accepted full responsibility, made no attempt to justify his actions.

In defence, it was claimed that he was "mortified" and had "very little recollection" of his bad behaviour.

In the Criminal Justice Social Work report the accused was deemed as a high risk of reoffending despite the gaps in his crimes. Maguire – who has a record for dishonesty and gun offences going back 35 years – has not been in trouble since 2013.

His lawyer highlighted that he engages with addiction services and runs recovery cafes. This is something Maguire hopes to continue with and gain employment to work with and help other substance users.

The sheriff took note of the mitigation presented and praised the positive work the accused was doing with others with a similar problem.

Maguire, of Kilmuir Road, was sentenced to a Community Payback Order with supervision for 12 months.

He was also handed 150 hours of unpaid work to be completed within six months.
