Prince Harry and Meghan Markle might be wise to sign a prenuptial agreement, a top divorce lawyer to the stars says.

Ayesha Vardag, founder of law firm Vardags, said a "prenup" is the "ultimate marriage insurance".

She said a prenuptial agreement would also acknowledge the modernity of the royal family.

"To mitigate the risk of things breaking down in future, it could be far better to take out the ultimate marital insurance - a prenuptial agreement," she said.

"Though the Crown Estates would likely be safe from divorce proceedings, the prince's personal wealth including his inheritance from his mother could fall into a financial settlement, as could Ms Markle's earnings from her acting career.

"Rather than placing this in the hands of the wide discretion which the court has, a prenup would allow them to agree a financial outcome which meets both their needs.

"More importantly, a prenup could incorporate privacy clauses, restricting either of them from sharing intimate details publicly."

She added: "Embracing a prenup would also be an important acknowledgment of the modernity of the royal family.

"Parties enter such an agreement as autonomous individuals, showing both husband and wife, prince and commoner, have agency in the process. It is a fantastic opportunity to engage as equals."

Vardag rose to fame in 2010 for winning the landmark Supreme Court case of Radmacher v Granatino, changing the law to make prenuptial agreements legally enforceable in England and Wales.
