A THIEF who suffers from “terrible anxiety” has avoided being tagged after claiming it would be “hell” and “terrifying” for her to be confined.

Victoria Allan, 34, was caught attempting to pinch £52.50 worth of clothing from Marks & Spencer in Argyle Street on October 14, 2017.

The accused was nabbed after she was spotted on CCTV going into a toilet with the items.

Glasgow Sheriff Court was told that Allan is already subject to four Community Payback Orders with 40 hours outstanding of an unpaid work order.

Defending, Miss Monaghan claimed that her client was now engaging with services despite the Criminal Justice Social Work report not being entirely positive.

Miss Monaghan explained that Allan seemed to commit offences after drinking alcohol, but has not touched a drop since January.

The defence agent said: “She has terrible anxiety.”

Miss Monaghan declared that it would be “hell” for Allan to be given a Restriction of Liberty Order (RLO) in which her movements at night would be limited to her house, adding: “It would be terrifying for her.”

It was also noted that a RLO would affect her events job at venues like Ayr Racecourse.

Sheriff Barry Divers highlighted that Allan gave her consent to being tagged whilst compiling the social work report.

Miss Monaghan replied: “She would wish to avoid it if possible given her health problems.”

Sheriff Divers deferred the case for the accused’s good behaviour and to monitor her progress on the other orders.

Allan, of Wester Gill Avenue in Airdrie, will return to court in four months.
