OUR readers are helping shape vital changes to the law governing factors.

Patricia Ferguson, MSP for Maryhill, Glasgow is behind a Scottish Parliament Bill that would force factors to be more responsible to the homeowners they represent.

Thanks to the Evening Times' campaign, she says residents are making their voices heard.

A key element of the Bill, which is fully supported by the Evening Times, requires factors to be registered. Currently, they are unregistered, unlicensed and anyone can set up as one.

The Bill would also create an independent body to mediate between residents and factors in dispute, which should reduce the need for court action.

Public consultation on the proposals is continuing, but Ms Ferguson said: "I have been inundated with responses since your campaign started.

"I will be using them, as well as some cases highlighted in the paper over the last week, to help shape the final legislation.

"I have been shocked at the number of calls and e-mails I have received from all over west Scotland and beyond.

"Many people are experiencing horrendous problems with their factor and all too often it is the same type of issues and the same factors cropping up again and again."

Our campaign has highlighted some of the problems facing the 100,000 city homeowners thought to have a factor. These included excessive charges, poor workmanship, unexplained bills and even court action.

We also launched our own charter an 11-point agreement aimed at getting a fairer deal for all residents, to which we want every factor in Glasgow to endorse.

We have had a massive response from readers, and politicians from all political parties have backed the campaign.

Glasgow MSP Bob Doris today showed his support by tabling a Parliamentary Motion congratulating the paper for highlighting the problem.

It would be good if everyone was "responsible". factors, owners, tenants, ET reporters, MSP.

Can anyone find details of the 11-point plan or Ms Ferguson's Bill? If Public consultation on Ms Ferguson's Bill ends on February 29 I would like to have a look at it.

By the way the only reason that such a Bill has not been introduced before is that it will highlight the real cost of maintaining properties and show that owners get off with murder while the poor tenants pay the owners fair share for them.

ok read it..

It's not very long and seems aimed fairly and squarely at the private factoring business.

I think it looks fine and written in good faith. If I were a factor i would be happy to sign up and recover the cost of the scheme from my customers. (I am not being sarky saying that btw).

Like most of this, when the hyperbole is side-stepped you come to the conclusion that managing large numbers of homes within buildings and estates with lots of communal parts is difficult, necessary and expensive. As I said at the outset today, anything that gives power to whoever has to deliver this service is a good thing. On the public housing side I think it is likely to push up the amount recovered from owners however. On the private side I think people will opt out and the stories ET carried at the end of the week and earlier this week will become more common.

Just read the "charter" and got the lnk from ryf (not bad site btw!)

The "Charter" is obviously cobbled together over a coffe by Marianne and has a degree of patronising tabloid speak. eg not how to change your factor, its how to sack your factor. Marianne is obviously from the thugs caged school rather than assailants jailed. It then has the amusing caveat that factors shouldn't resist sacking (despite acknowledging that owners have the legal right anyway).

Anyhoo, the other problem with it is that it representsthe classic dilema. Full of additional services, post inspection of jobs, detailed breakdown of invoices, meetings twice a year with everyone, perfect information for everyone, alternative quotes for every job aboother than very minor workss - all to be funded from what? Its silent on that bit other than making the ridiculous statement - inspect give breakdowns etc etc all as part of our existing management fee!!!!

Its all very depressing when I rememberthe ET as being a good wee paper.

Part of problem is that current Title Conditions legislation is being ignored by Factors, condoned by Residents Associations and the Courts because progressive management rules are only Default Rules that can be ignored or rejected on the basis of outdated feudal Titles and local feudal based Constitution documents

Several local MSPs are aware of the totally ineffective nature of the Management section of current Title Conditions legislation because Official Guidance on Default Rules has already been exploited in Court, and this legal loop-hole requires to be addressed by our legislators now, on an urgent basis, before factors can be brought to heel.

Best route would be to re-rate (from council tax) private dwellings and then the isssue of basic factoring such as cleaning would fall to the council or GCC LLP.
