The ex-Easter Road front man was recorded on a mobile phone singing "Hearts are going bust" in a capital pub in the hours before the Tynecastle clash on Sunday.
The footage of the 23-year-old, who sealed a £1million switch from Wolves to Parkhead in January, was posted on YouTube where it spread like wildfire.
Now the Scottish Football Association's compliance officer Vincent Lunny says the Scotland cap has a case to answer.
He has been accused of breaching Disciplinary Rule 86 - which demands players, staff or officials act in the best interests of the game - by singing in public about Heart of Midlothian FC in administration.
A principal hearing has been set for Thursday, April 24.
Hearts boss Gary Locke was questioned about the video on Tuesday morning and said: "I haven't seen it. Obviously you read about it and according to reports I've heard he is not a very good singer."
