This is a totally inappropriate sentence. The justice system in this country needs to get its priorities sorted out. Locking someone up for this kind of crime is criminal itself and frankly a waste of public money. A train painted a different colour; hardy a heinous crime now is it?

here this guy shouldnt have been locked up he should have been giving a fine i dont understand what the big problem with it is its not as if it look horrid. Most of the pieces that you see about are just big pieces of art and then some sad git somes along and washes it off and compains well if he wasnt such a sad little tit he would open his eyes and see that there is nothing wrong with this sort of thing

Another cowardly sentence and disgraceful example of the warped system of justice we live under. Rapists, sex offenders and violent criminals are given disproportionate sentences every day of the week in this country and this guy gets over 2 years for spraying graffiti...he might even have brightened some of the places up he was spraying.

our justice sytem is messed up. i love how they fail to mention that Gary has a full time job which he has been at for the past 3 years, he has a car, he is a part time carer for his mum, he has not been in trouble with the police since getting caught for painting the train (which was years ago)and he no longer paints. the judge knew all of this but chose to ignore it simply to make an example of him.

Happy with the sentence - can't understand why some think it's okay to damage the environment because its different to hurting a human being. If someone is interested in art, buy a canvass, go to art school, sell it on ebay. I can't abide the way grafitti 'artists' create eyesores across acres of public space and expect me to be grateful for their self-expression. The 'broken window' effect usually means graffitti is accompanied by further vandalism. Viewers don't have any choice but to see their work unlike those that elect to go to an art gallery of their own choosing. I don't give a monkeys that the person that ruined 270k worth of public property owns a motor and is nice to his ma. Fortunately, neither did the judge.

Good sentencing by the court in my opinion. Sick of the sight of tags all around the place. Also, the next time the train fares go up, have a wee think why. The amount of money spent on repairing trains that have been vandalised is a big factor.

ok your allowed your opinion, but something that is bought up here is that people convicted of serious offences to the person, which should take priority over damage to property, are getting lesser sentences than people convicted for grafiti, so can you say you agree with this?? you welcome over 2 years of someones life for an inconvenience, so what about a few pounds out of someones pocket/have to be careful what they do (asbo/sus sent.) for death, harm, distress to people and there familys??
Your ignoring the big point, not that someone is unished for graffiti, but people are being more seriously punished compared to crimes mentioned above.

For the curiosity of the readers of The Evening Times.
Heres a little bit of information:
Graffiti has been alive for over 30 years, it certainly does not plan to stop. No matter what barriers are ahead of Graffiti Artists - they will always win. Graffiti, seen in many eyes, is "plain vandalism". Not many actually stand back and look to see art. It is art. Fair nuff' on a listed or a government building, it would be seen as vandalism... But how often does that happen? Prices of cleaning the SPT Trains are outrageous in themselves. Bit of water and soap never hurt anycunt...
Yes, of course, the train that has been attacked will need to be closed, but its not as if it will cause massive corruption if one out of over 200 trains is off the line. For this legendary graffiti artist, his sentence is completely [bold]ridiculous[/bold] . You know you get a longer sentence for having possession of cocaine than a rapist does? This government doesn't know that if they actually thought of making these legal and reduce in "Cleaning up" Scotland, (being the sense of - never mind cleaning the walls), they wouldn't save millions...but Billions. Of course, there is an arguement of drugs and graffiti, but at the end of the day... its someones choice whether to do it or not. This society does not have the words, "Free speaking" in its dictionary. To express the feelings of Graffiti Artists - the walls say it all.
This sentencing of the legendary graffiti artist, "DAZE", does not send out any signals of failure or retreat to any graffiti artists of Scotland. It mearly alarms them to show more courage to express themselves more. The finding of this artist took over 3 years... bit slow arn't you, BTP? In what way did this artist indanger the lives of Staff [bold]OR[/bold] passangers? This quote is an utter lie. There is over 200 graffiti attacks every year on trains in Scotland [bold]alone[/bold]. Doesn't this give a clear signal to everyone that it will not stop?
Re-think the sentencing... go find the [bold]REAL[/bold] criminals.

Your comment is a clear example of lack of knowledge and consideration in which a Graffiti Artist's does at their best. Try looking on google for the artistic side to Graffiti. Search Graffiti Murals. Do you go up to the art school, look across the road and say, "Thats graffiti...i hate that s**t." Take a longer look. Think of how it can be done with a spray can... take some consideration, after all, this IS someones hobby.

When disproportionate sentences are dished out you have to wonder what factors are influencing judgement, as clearly the punishment does not fit the crime.
The language used to report was of course, deliberately provocative. Daze is in no way connected to "A Gang" he may be part of a collective or a crew but gang of course, is used to suggest violence & is the hacks way of misdirecting & demonising.
For the record Daze is an amiable 21 year old and as gar from a "Yob" as it is possible to get.
The Newspapers reported that Daze "... is now in prison after he admitted eight offences of malicious damage at Ayr Sheriff Court. When in actual fact only ONE was brought up in court, the only one he had admitted too.
A breakdown of exactly how the figure of £270,000 in damages was arrived would make for intersting reading also.
The sentence was welcomed by British Transport Police. Detective Chief Inspector Jim McKelvie said: "This sends out the signal that graffiti is nothing other than vandalism.

if you think 28 months sentence is appropriate then you must be insane!
i go out and i work from 9-5 everyday and it disgusts me that the government is wasting my hard earned cash on putting petty criminals in prison, while rapist and drug dealers walk around the streets and if i was to be attacked I would probably have to go to dirty understaffed hospital where i would catch some virus. give them community service cleaning graffiti and let them put something back into society instead of leeching off it. People have been drawing on walls for over 40,000 years(chauvet caves) graffiti is not going to stop so the sooner people realise that locking someone up is not a deterrent the better. In France they do not hand out jail sentences for graffiti but fine the offender instead.
people these days are so narrow minded they say yes it is art if done in the right place but don’t give them any place to do it not everyone has a big wall in there garden of house to paint there art.people these days swallow the rubbish that the media feed them the media is after all a government tool.
i dont care about the rail companys that charge me extortionate pricesses two stand up on a train for my entire journey value for money? no and not only that but im now paying for them to lock someone up for 28 months. i go out and i work from 9-5 everyday and it disgusts me that the government is wasting my hard earned cash on putting petty criminals in prison, while rapist and drug dealers walk around the streets and if i was to be attacked I would probably have to go to dirty understaffed hospital where i would catch some virus. give them community service cleaning graffiti and let them put something back into society instead of leeching off it. People have been drawing on walls for over 40,000 years(chauvet caves) graffiti is not going to stop so the sooner people realise that locking someone up is not a deterrent the better. In France they do not hand out jail sentences for graffiti but fine the offender instead.
people these days are so narrow minded they say yes it is art if done in the right place but don’t give them any place to do it not everyone has a big wall in there garden of house to paint there art.people these days swallow the rubbish that the media feed them the media is after all a government tool.
i dont care about the rail companys that charge me extortionate pricesses two stand up on a train for my entire journey value for money? no and not only that but im now paying for them to lock someone up for 28 months. So now im out of pocket because I pay tax on everything and I pay so much to travel but also there are dangerous criminals on the streets and health care service is rubbish.
I need to escape this insane country best justice system in the world…..I think not.

Justice? This is not justice, it's politics plain and simple. People have been given lesser sentences for violent assaults. Everyone in a fair society should be accountable for their actions, but it must all be in proportion otherwise the system does not work. In this case, the system has failed simply because the powers that be felt that making an example out of someone was more important than giving fair punishment. An ideal like this is more suited to communist China rather than democratic Britain.
In terms of the flagrant language of both the tabloids and Detective Chief Inspector Jim McKelvie of the British Transport Police it's hardly worth commenting on. What I will say though is that if anything they have created a martyr to other graffiti artists, not the so called "Graffiti Yob" as one paper put it.
On a final note: would the punishment have been so serious if it were a string of local business taking him to court rather than large authorities such as SPT and Railtrack? I think not. The whole thing disgusts me.

i feel the sentence is a complete joke as the courts arent fair about this crime in comparison to other more serious crimes. i know people get upset by having to look at things that they havent chosen to and feel graffiti writers should keep their art to themselves but if you live in society you have to live and see things you dont want to all the time, i feel that is a very immature argument to use personally. why is it ok for us all to endure endless ad campaigns everywhere we go if individual peoples art is not acceptable?

While this man is in prison he is not contributing to society paying his tax and national insurance just costing us money. Let him out soon.

Graffitti articulates a cultural desire to stake a claim in the aesthetics of our habitat, a visual space which is otherwise almost entirely dictated by commercial enterprises. Graffitti is a natural response. We should be discussing, encouraging and celebrating the drawings on our walls, as other European cities do. Are the courts BLIND to the fact there is an ENORMOUS car advert in George's square which contains a MASSIVE piece of graffitti? It seems the CRASS appropriation of graffitti culture is okay by the law as long as there a brand attached. Terrifying times. The judge should be ashamed of himself.

As a railway worker I'm over the moon this idiot is banged up. Every time some moron trespasses on the railway we have to bring in the Police and stop trains from running for the safety of some idiot trespasser. Network Rail picks up the tab for every delay minute which is due to vandalism. And as Network Rail is publicly funded who pays- the taxpayer. It's not as if this is a one off, he's a repeat offender and unrepentant.
Maybe he'll think twice, now he's counting the daze in jail.
